The plaintiff is appealing the dismissal of his suit for failure to amend his petition to join a necessary party. The trial judge granted the plaintiff ten (10) days within which to join a necessary party during which time the plaintiff took no action. Defendant's motion to dismiss plaintiff's suit upon failure to amend the petition was subsequently granted.
