Appellant was indicted in the Circuit Court of the Second Judicial District of Jones County on a charge of wilful, unlawful, felonious and knowing possession with the intent to sell, of a quantity, more than an ounce, of marijuana, a controlled substance, and on trial was found guilty of possession of marijuana with intent to sell, and, therefor was sentenced to a term of five years with the Department of Corrections.
