Alfred Labostrie was charged by the grand jury in the same indictment with two separate counts of distribution of a controlled dangerous substance, to-wit: heroin, in violation of La.R.S. 40:966. After trial by jury, defendant was found guilty of possession on count one and guilty as charged on count two. Separate sentences were imposed by the court on defendant for each conviction.
