On 11 January 1974, O'Quinn was indicted by a grand jury for the premeditated murder of his wife. On 14 March 1974, O'Quinn withdrew his previously entered plea of not guilty, pled guilty to first degree murder, and was sentenced to life imprisonment. On 24 December 1975, O'Quinn filed his motion to vacate judgment and sentence and for leave to withdraw his plea of guilty. The trial judge, who had not presided at the change of plea proceedings...
