OPINION

VOLLERS, Judge.

On October 28, 1974 appellant was tried for the offense of murder. A jury determined that he was guilty and assessed his punishment at confinement for life.

By ground of error number one the appellant complains that the appellant should not have been convicted in this cause because he had previously been acquitted of the same offense. The record reflects that on September 11, 1974 this cause was tried on the same indictment...
