This is an appeal by an employer from a judgment requiring it to pay plaintiff employee back wages, liquidated damages, and attorney's fees pursuant to the Fair Labor Standards Act.

This action was brought in early 1974, and in July of that year defendant employer filed its answer. In its answer defendant did not plead the exemption provided for administrative employees under 29 U.S.C. § 213(a)(1). The case was tried in September, 1975, still...
