Judgment modified, on the law, by (1) deleting so much of the first decretal paragraph thereof as denied plaintiffs' request for a declaratory judgment and substituting therefor a provision declaring that the rezoning of the subject parcel was not arbitrary or illegal spot zoning and (2) deleting the second decretal paragraph thereof and substituting therefor a provision declaring that section 85-62C (D) of the Zoning Ordinance of the Town of Brookhaven is constitutional...
