J., and COHALAN, J., concur with SHAPIRO, J.; SUOZZI, J., dissents and votes to (1) reverse the judgment and (2) modify the order by deleting therefrom the provision which granted the plaintiffs' motion for summary judgment and substituting therefor a provision denying the said motion, with an opinion.

SHAPIRO, J.

The defendants appeal from (1) an order of the Supreme Court, Kings County, dated December 2, 1975, which granted the plaintiffs' motion for summary judgment and denied their cross motion for leave to amend their answer and (2) the judgment entered thereon. We affirm.
