A bill of information dated November 12, 1976 charged Terrance L. Boyd with possession of marijuana. La.Rev.Stat. 40:966. Prior to trial Boyd filed a motion "to suppress any marijuana paraphernalia or marijuana seized." The motion is based upon the allegation that the marijuana was seized incident to an unlawful arrest because the arresting officer lacked probable cause.
