BUSSEY, Presiding Judge:

Appellant, Nolen Albert Linam, hereinafter referred to as defendant, was charged in the District Court, Tulsa County, Case No. CRF-76-1070, with the crime of Burglary of an Auto, in violation of 21 O.S. 1971, § 1435.
