Mathew Joseph, Bruce Fluker and Samuel Kelly were indicted by the grand jury of Orleans Parish for distribution of heroin. La.Rev.Stat. 40:966. Joseph and Fluker were jointly tried, but Kelly was severed, having waived his right to trial by jury. After trial by jury, Joseph was found guilty as charged and sentenced to life imprisonment.
