John Bays, Jr., filed his complaint on September 16, 1972, seeking a judgment, jointly and severally, in the sum of $13,000 compensatory damages and in the sum of $25,000 punitive damages, because of the Defendants/Appellants' alleged negligent conduct in allowing a large slag pile to accumulate and creating a hazardous condition which caused the damage to the Plaintiff/Appellee's truck.
