Earl Hall appeals from a jury conviction of burglary (K.S.A. 21-3715) and felony theft (K.S.A. 21-3701). Seven points are raised and will be considered, but first a brief statement of facts.

The J.C. Penney store at 722 Minnesota Avenue in Kansas City, Kansas, was burglarized at midnight on May 7, 1975. Two glass doors were broken and four green leisure suits worth $120 were missing. A witness...
