YOUNG, Justice.

This is an appeal from a summary judgment granted in favor of Miller & Freeman Ford, Inc.

Greater Houston Bank instituted this action initially to recover upon a note given for the purchase of a 1971 Ford pickup truck. The truck was sold at auction under court order and the proceeds, $1,100.00, were deposited in the registry of the court.
