On September 19, 1973, the Vernon Parish Grand Jury indicted defendant for the first degree murder of LeRoy Jackson, a violation of La.R.S. 14:30. Defendant's motion to quash the indictment on the grounds that the first degree murder statute is unconstitutional was granted by the trial court.
