John Kutnick, the plaintiff, was injured when the automobile he was driving was struck by a car driven by the defendant, James B. Grant. The plaintiff filed a complaint in the circuit court of Cook County. Subsequently, depositions were taken and the plaintiff submitted to a medical examination the defendant had requested.
