On November 24, 1974, Learnas Smith was killed by a bullet fired from his own gun. His wife, Maggie Smith, the appellant herein, was taken into custody and held by the police for two days without being charged. After a writ of habeas corpus was filed in the Court of Common Pleas, appellant was charged with voluntary manslaughter.
