Appellant, Leroy Jessie Thomas, hereinafter referred to as defendant, was conjointly charged with one Carl A. Swift in the Comanche County District Court, Case No. CRF-74-136, for the offense of Murder in the First Degree in violation of 21 O.S.Supp. 1973, § 701.1, ¶ 2.
