DIXON, Justice.

The defendant, Clifton Ardoin, was charged with a violation of R.S. 14:34 aggravated battery. A six man jury found the defendant guilty as charged and he was sentenced to serve five years and one day in the parish jail. The State produced evidence that, on the night of August 9, 1975, Leonard Alcide, Jr. and Clifton Ardoin were in the Tip Top Bar in Eunice, Louisiana.
