OPINION

NYE, Chief Justice.

This is an appeal from a declaratory judgment declaring that Reynaldo Ruiz was not qualified to be paid compensation as a Justice of the Peace while he also maintained employment as a public school teacher.

Reynaldo Ruiz was elected Justice of the Peace for Precinct 3, Place 2 in Hidalgo County, Texas, for a second term in November 1974 and has been discharging his duties as Justice of the Peace since January 1, 1975....
