ROBERTS, Judge.

This is an appeal from a conviction for delivery of a controlled substance, to wit, lysergic acid diethylamide.1 A jury found appellant guilty on December 12, 1974 and assessed his punishment at nine years' imprisonment. The offense occurred on May 1, 1974.
