In 1968, the petitioner Mark Frasier was convicted in New York County Supreme Court for robbery in the first degree, assault in the first degree, and possession of a loaded firearm. Based on his plea of guilty in 1961 to grand larceny in the second degree, he was sentenced as a second felony offender to concurrent terms of fifteen to sixteen years on the robbery count, two and one-half to ten years on the assault...
