The appellant, Richard Sanders, hereinafter referred to as the defendant, was charged, tried and convicted by jury trial in the District Court, Oklahoma County, Case No. CRF-74-3170, with the offense of Murder in the First Degree in violation of 21 O.S.Supp. 1973, § 701.1.
