These consolidated cases arose out of an incident in which defendant Vincent Brouillette deliberately drove a bulldozer into a wooden frame house allegedly owned by plaintiff, knocking the house from its foundation and causing it to be extensively damaged. In the first suit, plaintiff sought to recover from his insurer, Phoenix Insurance Company of New York, the policy limits of $10,000 under the malicious mischief and vandalism portions of the policy...
