Appellant was found guilty of possession of marijuana with the intent to deliver in violation of Ark.Stat.Ann. § 82-2617 (Supp.1973). A three year sentence in the State Department of Correction was imposed. We first consider appellant's contention that his conviction for possession with intent to deliver was contrary to the evidence and the state failed to meet its burden of proof.
