No. 73-322.

309 So.2d 608 (1975)

In the Interest of G.C.O., a Child, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

Rehearing Denied April 7, 1975.

Attorney(s) appearing for the Case

James A. Gardner, Public Defender, and Thomas A. Capelle and Ellen Condon, Asst. Public Defenders, Tampa, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and Richard C. Booth, Asst. Atty. Gen., Tampa, for appellee.

HOBSON, Acting Chief Judge.

After an adjudicatory hearing the child was found to be delinquent. The child appeals from this order.

The child was accused of shooting one Thomas Tucker with a pistol, thereby causing his death. There were no eye-witnesses to the incident and, therefore, the prosecution had to rely on circumstantial evidence to establish the unlawful homicide beyond a reasonable doubt.
