OPINION OF THE COURT

O'BRIEN, Justice.

Appellant, Norris Jones, was tried by a judge and jury and found guilty of murder in the second degree. Post-trial motions were denied and appellant was sentenced to a term of 5 to 12 years in a state correctional institution. This appeal followed.

Appellant's conviction arose out of the fatal stabbing of Dennis Stancko on October 8, 1971, in Erie, Pennsylvania.
