Mr. JUSTICE DIXON delivered the opinion of the court:

Defendant, Ophem Falconer, was indicted along with a co-defendant Ronald Doss by the Winnebago County grand jury for murder committed in the course of a grocery store robbery. The two men were tried together, both being represented by the same attorney, found guilty by a jury and sentenced to death. On appeal the Illinois Supreme Court vacated the death sentences, but affirmed the convictions...
