This action was commenced by appellant, Realty Executives, Inc. (Realty), a real estate brokerage firm, to collect a broker's commission from appellee, Northrup, King & Co. (Northrup), after Northrup sold a parcel of land to Holsum Bakery. Realty alleged that Northrup wrongfully refused to pay the commission in violation of an exclusive listing agreement.
