This is an appeal by the defendant appellant, James Davis, from a conviction in the Common Pleas Court of Cuyahoga County for the first degree murder, in violation of R. C. 2901.01, of one Ellen Dawes, who was killed after having been shot in the head three times. Her husband, Charles Dawes, defendant appellant, James Davis, Billy Gene Carnes and Annabell Thompson were all indicted for the murder of Ellen Dawes. Charles Dawes was tried and found guilty...
