This case is before us pursuant to the grant of an out-of-time appeal by the Honorable Tom Blackwell, Judge of the 167th District Court of Travis County on May 30, 1974. On original submission, the appeal was dismissed in an opinion by Commissioner Dally on January 15, 1975 because of the absence from the record of any evidence justifying the grant of the out-of-time appeal.
