On July 26, 1973, Western Amusement Company, Inc. (Western) brought a writ of review proceeding1 against the City of Springfield (City) seeking to reverse and annul the action of the City in assessing Western with a proportionate share of the cost of improving a street abutting Western's property. The circuit court sustained Western's objections and declared the assessment null and void.
