HUFSTEDLER, Circuit Judge:

In this diversity action the district court granted summary judgment in favor of appellee Tang in her action to collect the proceeds of a life insurance policy on the life of appellant Jong's wife. Jong is the primary beneficiary of the policy. Tang, the decedent's mother, is the alternate beneficiary. Jong killed his wife in San Diego, California, in 1972.
