Mr. JUSTICE DRUCKER delivered the opinion of the court:

Defendant was indicted with Sam Calhoune and Arthur Shepard for the murder of Horace Kimbrough in violation of section 9-1 of the Criminal Code. (Ill. Rev. Stat. 1969, ch. 38, par. 9-1.) Tried alone without a jury, defendant was found guilty and sentenced to a term of 20 to 40 years.
