On April 23, 1973 one Frederick Kruger was robbed at the Hotel Touraine in the City of Albany. As a result of this incident, the defendant and two other men were indicted for the crime of robbery in the first degree (Penal Law, § 160.15, subd. 3). After a jury trial, the defendant was convicted as noted above and sentenced to an indeterminate term of imprisonment not to exceed 15 years.
