On November 16, 1962, defendant was convicted of first degree murder and sentenced to death. On appeal, we affirmed the conviction of guilt, but reversed the penalty. (People v. Hillery (1965) 62 Cal.2d 692 [44 Cal.Rptr. 30, 401 P.2d 382].)...
