Plaintiff executor seeks to have his testator's will construed, and ask the court to declare his duties thereunder. After the usual first item directing the payment of debts and funeral expenses, testator provides in Item 2 that:

"ITEM 2. All the rest, residue and remainder of my estate, be the same real, personal or mixed, wheresoever situate and whether now owned or hereafter acquired, I give, devise and bequeath to Glenn G. Moysey, Jr., in Trust...
