STRUCKMEYER, Justice.

On May 30, 1968, Ramon Marquez died, and thereafter his widow, Maria, filed a claim for death benefits under Arizona's Workmen's Compensation Act. Her claim was denied by the Industrial Commission, and she brought certiorari. The Court of Appeals affirmed the award of a non-compensable claim, Marquez v. Industrial Commission, 19 Ariz.App. 139,
