The defendant, Askold Kohlmann, was indicted on two counts, the first count charging illegal importation of approximately 116 grams of cocaine, in violation of 21 U.S.C. § 952(a), and the second count charging possession with intent to distribute it, in violation of 21 U.S.C. § 841(a)(1).
