CALLISTER, Chief Justice:

Defendants appeal from their conviction by a jury of the crime of assault with a deadly weapon, Section 76-7-6, U.C.A. 1953. Both defendants were sentenced to the Utah State Prison for the term provided by law; however, Mrs. Dowell's sentence was suspended and she was placed on probation on the condition that she serve 30 days in jail or in the alternative pay a fine and make restitution.
