Martinez-Miramontes appeals his conviction for possession of marijuana with intent to distribute, a violation of 21 U. S.C. § 841(a) (1). Jurisdiction in the District Court was based upon 18 U.S.C. § 3231; this court's jurisdiction is predicated upon 28 U.S.C. § 1291.
