On May 23, 1973, the third-party defendant United States of America moved this Court to dismiss the third-party complaint for lack of jurisdiction under the Federal Tort Claims Act (FTCA; 28 U.S.C. §§ 1346 and 2671 et seq.). On May 31, 1973, this Court denied said motion.

Subsequently, at the suggestion of the Court, the United States of America moved for reconsideration of its motion.
