This matter is before the Court on the motion of the defendant, Vulcan Materials Company (Vulcan), for summary judgment. Vulcan is a chemical plant characterized by its mechanical manager, Lewis J. Fairbanks, as "a chlorinated solvents plant." It makes "industrial solvents by chlorinating hydrocarbons."
