On December 24, 1971, defendant-appellant, Edgar M. Neal, pleaded guilty to first-degree murder and was sentenced to life imprisonment in the state penitentiary. Eleven months later he filed a motion, pursuant to Crim.P. 35(b), seeking to have the plea and sentence set aside on the grounds that his plea was involuntary.
