ONION, Presiding Judge.

This is an appeal from a conviction for robbery by assault wherein the punishment was assessed at thirty-five (35) years by the court following a verdict of guilty.

The sufficiency of the evidence is not challenged. Suffice it to say the record reflects the complaining witness Shotwell and his fellow employee at a Dallas service station, Dixon, left work about 10 p. m. on February 11, 1971, and went to a small cafe...
