Per Curiam.

The first proposition of law presented by both parties in this cause concerns whether the Court of Appeals erred in allowing the state leave to appeal the decision of the trial court in the postconviction relief proceedings.

Section 3(B)(2) of Article IV of the Constitution of Ohio provides, as did its predecessors in analogous language:

"Courts of Appeals shall have such jurisdiction...
