Defendant appeals from a conviction for burglary second degree and stealing.
At about 4:00 a. m. on August 11, 1971, deputy Sheriff Baxter was proceeding northbound on Highway 169 near Smithville, Missouri. At that time, he saw an automobile driven by defendant proceeding in the opposite direction.
