The matter before us involves a drowning which occurred in the Capitol Avenue Swimming Pool in the City of Baton Rouge. The pool is used as part of a playground and is owned by the Recreation and Parks Commission for the Parish of East Baton Rouge (hereinafter referred to as BREC).
