Plaintiff appeals from an order of the trial court granting accelerated judgment for defendants and dismissing plaintiff's action with prejudice. GCR 1963, 116.1(3). More specifically, plaintiff does not take issue with the dismissal as such, but contends that this action should not have been dismissed with prejudice. We agree.

Plaintiff originally filed suit on June 2, 1972 seeking to foreclose a mechanic's lien on certain property of defendants...
