OPINION

ONION, Presiding Judge.

This is an appeal from a conviction for the offense of driving while intoxicated, subsequent offense, the punishment being assessed at five (5) years in the Texas Department of Corrections.

Appellant was convicted for driving a motor vehicle while in a state of intoxication in Andrews County on June 27, 1971. The jury found that appellant was one and the same person that had been previously convicted of a misdemeanor...
